SNPT Law

The Special Needs Pooled Trust (SNPT) was established by a Federal Act called the Omnibus Budget Reconciliation Act of 1993. Individual state requirements follow the federal protocol. Arlington Heritage Group created a Special Needs Pooled Trust Prototype that meets all federal and state requirements. Any non-profit organization may establish its own Special Needs Pooled Trust under the Arlington Heritage Group Provider Trust.

 

The requirements are as follows:

  1. Trust is established by a non-profit organization.
  2. Funds in the trust do not count towards assets of the individual. Funds are to be used solely for the benefit of the individual.
  3. Separate accounts are maintained for each individual; funds are pooled for investment purposes.
  4. The balance remaining in the trust at the time of death can be retained by the Agency SNPT or returned to the State.


The purpose of the SNPT is to establish a repository in compliance with federal and state laws so that funds of persons with disabilities may be held for the individual’s extra and supplemental needs. These needs are not covered by governmental programs or benefits.
